How we work together

The terms that apply to every project and care plan. Written to be read, not skimmed past.

1. About these terms

These terms apply when CramondSoft ("we") builds a website or application, or provides a care plan, for your business ("you"). Your written quote and these terms together make up our agreement. If the quote and these terms disagree, the quote wins.

Our services are for businesses. If you have a question about any of this, ask before you accept a quote: [email protected].

2. Quotes and fixed prices

Before any work starts, we send you a written quote. It says what we will build, what is included and the fixed price. The price does not change unless the work changes.

If you ask for something that isn't in the quote, such as extra pages, features or a change of direction after a design is agreed, we tell you the cost first. Nothing extra is charged unless you agree to it in writing, and an email is enough.

Extra work is charged at £25 an hour for our first 10 clients (our launch rate), and £40 an hour after that. Launch prices on our pricing apply to our first 10 clients.

We are not VAT registered, so no VAT is added to our prices.

3. Payment

  • Projects: 50% of the price before we start, and the remaining 50% at launch, before the finished site is handed over.
  • Extra work: invoiced once it is done, unless we agree otherwise.
  • Care plans: paid monthly in advance.

If a payment is late, we may pause work or care plan services until it is paid. We will always tell you before we do.

4. Ownership

Owning what you pay for is the point of working with us.

  • Accounts: your domain, hosting and email accounts are opened in your business's name from the start. You hold the keys; we are given access to do the work.
  • Code, design and content: once the project is paid in full, everything we made for it is yours: the code, the design and the content.
  • Your data: is always yours.

Some parts of a site use tools made by others, such as open-source software or fonts. These stay under their own licences, which allow you to keep using them.

We may mention that we built your site, for example in a list of our work, unless you ask us not to.

5. What we need from you

  • The words, images, logos and other material you want on the site, on time.
  • Confirmation that you have the right to use what you give us. For example, photos you took or bought a licence for.
  • Feedback and decisions within a reasonable time. If we are waiting on you, the launch date moves back by the same amount.
  • Access to any existing accounts we need, such as a domain you already own.

6. Care plans

Care plans are optional and run month to month. You can cancel with 30 days' notice, by email. Your site keeps running either way, because it is already in your accounts.

Work beyond a plan's included time is charged at the hourly rate in section 2, quoted first.

7. Cancellation and refunds

If you cancel

You can cancel a project at any time by telling us in writing.

Payments already made are non-refundable once work has started. They pay for time we have set aside for your project and work already done.

  • We hand over everything built so far.
  • You don't pay the rest of the price for work we haven't done.
  • Care plans: you can cancel with 30 days' notice. A month that has already started is not refunded.

If we can't deliver

If we cancel the project, or can't deliver what your quote says we will, we refund what you have paid for the work we haven't delivered.

If something isn't right

If something we built doesn't work as agreed, tell us and we will fix it at no cost. If we can't fix it within a reasonable time, the paragraph above applies to that part of the work.

Nothing in this section takes away any rights you have by law.

8. Free previews

A preview is a concept website we build before you have agreed to anything. It is free and there is no obligation.

  • If you go ahead, we build your real site on top of the preview, under the terms above.
  • If you don't want it, tell us and we take the preview down within 30 days and don't contact you again. See our preview page.

9. Hosting and other providers

Hosting, domains, email and similar services are billed to you directly by the provider, at their price. We don't add a margin.

These providers run their own services. We are not responsible for their outages, price changes or decisions, but on a care plan we will help you deal with them.

10. Liability

We build carefully and test before launch. If something we built doesn't work as agreed, tell us and we will fix it.

Our total liability to you for a project is limited to the amount you have paid us for that project. For a care plan, it is limited to the fees you paid in the 12 months before the problem arose. We are not liable for indirect losses, such as lost profits or lost business.

Nothing in these terms limits liability that the law does not allow to be limited, such as for death or personal injury caused by negligence, or for fraud.

11. Law

These terms are governed by the law of Scotland, and the Scottish courts deal with any dispute. We would always rather sort a problem out by talking first.
